Hip replacement claims

In 2010 the DePuy ASR Acetabular and ASR Hip Resurfacing System hip replacement models were recalled after concerns over their high failure rate, links with non-cancerous tumours and their metal particles causing significant tissue damage. The implants were found to be leaking high amounts of cobalt and chromium into the body. The failure rates of the DePuy ASR are also very high. According to the British Orthopaedic Association, DePuy ASR failure rates range from 21% after 4 years to 49% after six years. Other types of metal on metal hip replacement could also be affected.

Symptoms that may be linked to a defective metal on metal hip replacement include:
  • Pain in the groin or hip area
  • Difficulty walking
  • Clicking of your hip
  • Swelling
  • Numbness or loss of feeling in your leg
93,000 people across the world received the DePuy ASR implants. For many patients in Scotland who have been affected they have had to have corrective surgery or are still living in a lot of pain. We have only had one Unison member in the whole of Scotland enquire about pursuing such a claim. Given the number of these hips that were used and the number of Unison members in Scotland, we are concerned that there may not be awareness that access to compensation can be sought through Unison and perhaps your members are seeking alternative advice from claims companies. It is understood that DePuy have engaged a company, Broadspire, to try and keep the amount of compensation they have to pay to people to a minimum.
